1. About HurtSOS

HurtSOS is a service of TruePath Recovery Services ("Company," "we," "us," or "our"), a care coordination company that connects accident victims with towing providers, medical care professionals, and legal professionals. Our principal place of business is located at Delaware 19901-3618.

HurtSOS is not a law firm, medical provider, or insurance company. We are a referral and coordination service. We connect you with licensed third-party professionals but do not directly provide legal advice, medical treatment, or insurance coverage.

3.6 Message and Data Rates

Message and data rates may apply. Messaging charges are applied by your mobile carrier and are not collected by HurtSOS. Please check with your mobile carrier if you are unsure about your messaging plan.

3.7 Supported Carriers

Our SMS program is compatible with all major U.S. carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, US Cellular, and their MVNOs. Carrier coverage is not guaranteed in all areas. HurtSOS and mobile carriers are not liable for delayed or undelivered messages.

3.8 Consent Not a Condition of Service

You are not required to consent to receive SMS or phone calls as a condition of receiving any services from HurtSOS. Your coordination services will not be withheld, limited, or degraded based on your choice to opt out of SMS communications.

4. Telephone Consumer Protection Act (TCPA) Compliance

We comply with the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations. When you provide your telephone number, you expressly consent to be contacted at that number by HurtSOS and its affiliated providers. This consent may include calls and texts delivered via automatic telephone dialing systems (ATDS) or artificial/prerecorded voice messages, unless you opt out.

HurtSOS connects clients with third-party service providers including medical professionals, attorneys, and towing companies. We do not employ, supervise, or control these providers. We make no warranty or guarantee regarding the quality, outcome, or results of services provided by third parties.

We are not responsible for any acts or omissions of third-party providers. Any disputes regarding services provided by third parties must be addressed directly with those providers.

7. Limitation of Liability

To the fullest extent permitted by law, HurtSOS and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

Your use of our services is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our practices regarding your personal information, including how we collect, use, and protect your mobile number and consent records.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state where TruePath Recovery Services is incorporated, without regard to conflict of law provisions.
